Please read these Terms carefully. By accessing or using the Site, or by requesting a quote or engaging our services, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Site.

Alpha Petroleum provides petroleum and oil transportation and logistics, environmental services, hazardous materials transport and disposal, freight and trucking, and related training. Our services include, without limitation, crude oil transportation and logistics, bulk and chemical transport, vacuum tanker and roll-off transport, remediation, on-site and industrial cleanup, oil spill cleanup, hazardous and universal waste transportation and disposal, contaminated soil and wastewater disposal, fuel polishing, 24/7 emergency response, and safety and compliance training. Information on the Site describes our services in general terms and does not constitute an offer, a guarantee of availability, or professional, engineering, legal, or regulatory advice. The specific scope, pricing, and terms of any work we perform are governed by a separate written agreement, service contract, work order, or accepted quote between you and Alpha Petroleum.
Quotes provided through the Site or otherwise are estimates based on the information available at the time and are not binding until confirmed in writing by an authorized representative of Alpha Petroleum. Quotes may be subject to change based on site conditions, material characterization, volume, access, regulatory requirements, fuel and surcharge adjustments, scheduling, and other factors. Any work we perform is subject to the terms of a written service agreement, contract, or accepted work order, which will control in the event of any conflict with content on the Site. You agree to provide accurate and complete information about the materials, sites, and services involved, and you acknowledge that inaccurate or incomplete information may affect pricing, scheduling, safety, and compliance.
You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to use the Site: in any way that violates any applicable federal, state, local, or international law or regulation; to transmit any advertising or promotional material without our prior written consent, including any junk mail, chain letter, or spam; to impersonate or attempt to impersonate Alpha Petroleum, an Alpha Petroleum employee, another user, or any other person or entity; to introduce any viruses, malware, or other material that is malicious or technologically harmful; or to engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Site, or that may harm Alpha Petroleum or users of the Site or expose them to liability.
The Site and its entire contents, features, and functionality, including but not limited to all information, text, displays, images, video, audio, logos, and the design, selection, and arrangement thereof, are owned by Alpha Petroleum, its licensors, or other providers of such material, and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or otherwise exploit any content on the Site except as expressly permitted by these Terms or with our prior written consent. The Alpha Petroleum and Alpha Environmental Engineering & Construction names and logos are trademarks of Alpha Petroleum and may not be used without our prior written permission.
Alpha Petroleum performs regulated services involving petroleum, hazardous materials, and hazardous waste. We conduct these services in accordance with applicable federal, state, and local laws and regulations, including those administered by the U.S. Department of Transportation, the U.S. Environmental Protection Agency, the Occupational Safety and Health Administration, the California Department of Toxic Substances Control, and other regulatory authorities, as applicable to a given engagement. Content on the Site regarding regulatory requirements, permits, compliance, safety, or environmental outcomes is provided for general informational purposes only, may not reflect the most current legal or regulatory developments, and does not constitute a representation, warranty, or guarantee of compliance or of any particular result. You are responsible for your own compliance obligations, including accurate characterization, labeling, and disclosure of materials, and for any permits, manifests, or approvals required on your side of an engagement. Nothing on the Site creates any duty on the part of Alpha Petroleum beyond the duties set out in a signed written agreement.
The Site and all content on it are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied. To the fullest extent permitted by law, Alpha Petroleum disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Alpha Petroleum does not warrant that the Site will be uninterrupted, secure, without errors, or without viruses or other harmful components, or that any information on the Site is accurate, complete, reliable, current, or without errors. This section does not affect any warranties that cannot be excluded or limited under applicable law, and it does not apply to warranties expressly set out in a signed written service agreement.
To the fullest extent permitted by law, in no event shall Alpha Petroleum, its affiliates, or their respective officers, directors, employees, agents, licensors, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, arising out of or relating to your access to or use of, or inability to access or use, the Site or any content on it, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been advised of the possibility of such damages. Liability arising from services we perform is governed exclusively by the signed written agreement covering those services. Nothing in these Terms limits or excludes liability that cannot lawfully be limited or excluded.
You agree to defend, indemnify, and hold harmless Alpha Petroleum, its affiliates, and their respective officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your misuse of the Site, your provision of inaccurate or incomplete information regarding materials or sites, or your violation of any applicable law or the rights of a third party. This provision is in addition to, and does not replace, any indemnification obligations set out in a signed written service agreement.
The Site may contain links to third-party websites or resources that are not owned or controlled by Alpha Petroleum. We provide these links for convenience only and are not responsible for the content, products, services, or practices of any third-party site. Your use of any third-party site is at your own risk and subject to that site's terms and policies.
These Terms and any dispute or claim arising out of or relating to them or to your use of the Site are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that any legal action or proceeding arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to the personal jurisdiction and venue of those courts.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified or eliminated to the minimum extent necessary, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy and any signed written agreement between you and Alpha Petroleum, constitute the entire agreement between you and Alpha Petroleum regarding the Site and supersede all prior understandings regarding the Site. In the event of a conflict between these Terms and a signed written service agreement, the service agreement controls with respect to the services it covers.
